Do not use with real guests until reviewed and approved by a licensed attorney. --- ACTIVITY WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK Property: Komodo Springs Location: Red River Gorge, Kentucky Version: 1.0 By signing this document, you agree to all of the following terms: 1. ACKNOWLEDGMENT OF RISKS Outdoor activities including but not limited to hiking, trail use, waterfall access, rock exploration, campfire use, and use of property terrain involve inherent and serious risks, including the risk of serious injury, illness, disability, or death. These risks exist whether you are experienced or inexperienced. 2. ASSUMPTION OF RISK You voluntarily and knowingly assume all risks associated with your access to and use of the Komodo Springs property and any outdoor activities undertaken thereon. You acknowledge that no amount of care, caution, instruction, or expertise can eliminate all risks. 3. RELEASE OF LIABILITY In consideration of being permitted access to Komodo Springs property, you, on behalf of yourself and your heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue Komodo Springs, its owners, officers, employees, agents, volunteers, and representatives from any and all claims, demands, losses, or liability arising out of or related to any injury, damage, or loss to person or property, whether caused by negligence or otherwise. 4. MEDICAL AUTHORIZATION In the event of an emergency, you authorize Komodo Springs staff to contact emergency services and provide basic first aid. You are responsible for your own health decisions and medical expenses. 5. RULES AND POLICIES You agree to follow all posted rules, staff instructions, trail markers, and safety guidelines while on the property. Failure to comply may result in removal from the property. 6. PROPERTY CARE You agree to practice Leave No Trace principles, respect wildlife, not disturb other guests, and leave the property in the condition in which you found it. 7. PHOTO AND MEDIA RELEASE You grant permission for Komodo Springs to photograph or record your likeness during your visit for use in promotional materials, unless you specifically opt out in writing. 8. EMERGENCY CONTACT You confirm that your emergency contact information provided at registration is current and accurate. 9. GOVERNING LAW This agreement shall be governed by the laws of the Commonwealth of Kentucky. 10. SEVERABILITY If any provision of this agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect. --- NOTICE TO SIGNATORIES: This is a placeholder document.
